What information do you like to receive in advance of a mediation?
A confidential pre-mediation statement setting forth the factual and legal issues, strengths and weaknesses of the case, status of discovery (if in suit), negotiation history, and potential obstacles to settlement. A confidential pre-mediation call can also be very helpful.
What is the format you use for the mediation?
A general session and then caucus. There is a trend to eliminate the general session. The benefits of it should be considered in advance of the mediation and discussed. The process is fluid and different approaches may be helpful during the mediation. For example, having the mediator facilitate a conversation with the parties.
What are your fees?
Fees vary depending on several factors including the number of parties and complexity of issues, etc. Please contact us for further information.
